Governing All Web Engineering, Cloud Architecture & Security Audits
Welcome to Cyber Warrior. By accessing our website, engaging our services, signing a Statement of Work (SOW), or making milestone payments, you agree to be bound by these Terms of Service.
1. Scope of Engagement & Delivery
Cyber Warrior provides bespoke software development, web applications, cloud infrastructure engineering, and cybersecurity audits. Specific technical requirements, milestones, timelines, and budgets are executed via individual Statements of Work (SOW) or written proposals.
2. Intellectual Property (IP) Rights & Ownership
- Client Ownership: Upon receipt of 100% full and final payment for a completed project, all custom source code, design assets, and client-specific deliverables created for the project are assigned exclusively to the Client.
- Pre-existing IP & Frameworks: Cyber Warrior retains ownership over pre-existing code libraries, developer tools, reusable modular components, and internal frameworks incorporated into the project. The Client receives a perpetual, non-exclusive, royalty-free license to use these embedded components.
3. Billing, Taxes & Payment Schedules
- Projects operate on milestone-based schedules outlined in the SOW (typically advance deposit, intermediate milestone approval, and final deployment).
- All invoices are subject to 18% Goods and Services Tax (GST) as applicable under Indian Tax Laws.
- Invoices not paid within 15 days of the due date may incur late fees or temporary suspension of active development environment hosting.
4. Client Responsibilities & Authorization
For cybersecurity audits, vulnerability assessments, and penetration testing (VAPT):
- The Client explicitly warrants that they possess full legal ownership or express written authorization for all domain names, servers, and IP addresses target-tested by Cyber Warrior.
- Cyber Warrior accepts no liability for third-party hosting service disruptions resulting from authorized stress-testing or penetration testing protocols.
5. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Cyber Warrior's cumulative monetary liability for any claim arising out of or related to our services shall not exceed the total amount paid by the Client to Cyber Warrior for the specific project or SOW in question during the 6 months prior to the incident.
6. Governing Law & Jurisdiction
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts in Aligarh, Uttar Pradesh, India.
